This notice is being sent to inform you that a settlement has been reached =
in a class action lawsuit claiming that Defendant, GameStop, Inc., disclose=
d its online video game customers=E2=80=99 personally identifiable informat=
ion (=E2=80=9CPII=E2=80=9D) to Facebook via the Facebook Tracking Pixel wit=
hout consent in violation of the Video Privacy Protection Act (the =E2=80=
=9CVPPA=E2=80=9D). The VPPA defines PII to include information which identi=
fies a person as having requested or obtained specific video materials or s=
ervices from a video tape service provider.<strong> </strong>Defendant deni=
es that it violated any law but has agreed to the settlement to avoid the u=
ncertainties and expenses associated with continuing the case.
</p><p style=3D"margin:0;margin-bottom:16px"><u><strong>Am I a Settlement C=
lass Member?</strong></u> Our records indicate you may be a Settlement Clas=
s Member. Settlement Class Members include all individuals who purchased a =
video game from the GameStop website from August 18, 2020, through April 17=
, 2025, and who, at the time of that purchase, (i) were a member of Faceboo=
k and (ii) maintained a public Facebook profile using their actual name.</p=
><p style=3D"margin:0;margin-bottom:16px">
<u><strong>What can I get in this Settlement?</strong></u> If approved by t=
he Court, Defendant will establish a Gross Settlement Amount of $4,500,000 =
to pay all valid claims submitted by the Settlement Class, together with no=
tice and administration expenses, attorneys=E2=80=99 fees and costs, and in=
centive awards. Under the terms of the Settlement, you may elect to receive=
 either a Cash Payment of up to $5 or a Voucher of up to $10 for use on Gam=
eStop=E2=80=99s website. The Settlement also requires Defendant to suspend =
operation of the Facebook Tracking Pixel on any pages on its website where =
it would capture the title of a video game purchased that contains cut scen=
es that are like the type of content generally covered by the VPPA, unless =
and until the VPPA is amended, repealed, or otherwise invalidated by judici=
al decision as applied to the use of website pixel technology or such video=
 games generally, or until Defendant obtains VPPA-compliant consent for the=
 disclosure of such video game titles to Facebook.

ment?</strong></u> You must submit a timely and complete Claim Form <strong=

0 Adams Street, Brooklyn, NY 11201. At that hearing, the Court will hear an=
y objections concerning the fairness of the Settlement, determine the fairn=
ess of the Settlement, decide whether to approve Class Counsel=E2=80=99s re=
quest for attorneys=E2=80=99 fees and costs, and decide whether to award th=
e Class Representatives $5,000 each from the Gross Settlement Amount for th=
eir service in helping to bring and settle this case. Defendant has agreed =
to pay Class Counsel reasonable attorneys=E2=80=99 fees in an amount to be =
determined by the Court. Class Counsel will seek no more than one-third of =
the Gross Settlement Amount, but the Court may award less than this amount.
